Landlord Responsibilities
When you become a Landlord you automatically take on legal obligations and incur additional costs that you would not normally incur if you were living in the property yourself.
Such additional expenses may include a Gas Appliance Safety Certificate. This certificate is required annually to certify the safety of gas appliances and usually costs around £75 per property. Likewise all furniture and curtains fitted need to comply with current fire regulations.
If heating, lighting and water services are temporarily unserviceable the tenant can withhold rent which may affect your ability to pay the mortgage.
Whilst Blue Force Property Ltd will generally make sure that you fulfill your legal obligations you are ultimately responsible.
Landlord and tenant obligations
It is vital that you are aware of your legal rights and obligations. The law protects both parties and does not permit you to “take the law into your own hands”, irrespective of circumstances. It is important that landlords fully understand their obligations.
The Disability Discrimination Act, Sex Discrimination Act and Race Relations Act also apply to anyone letting, selling or managing premises.
What is the landlord responsible for?
- Repairs to the structure and exterior of the property, heating and hot water installations, basins, sinks, baths and other sanitary installations
- The safety of gas and electrical appliances
- The fire safety of furniture and furnishings provided under the tenancy
- Ensuring that the property is fit for habitation
- Repairing and keeping in working order the property’s heating and water system
- The common areas in multi-occupancy dwellings
What is the tenant responsible for?
- Paying the rent as agreed and taking proper care of the property
- Bills for gas electricity, telephone, etc if this was agreed at outset
- In most cases, paying the council tax, water and sewerage charges
What do I need to do about tax?
Blue Force Property Ltd will provide your Land and Property page to be included with your tax return together with advice on whether you need to submit any tax return. If you have complex financial affairs you may need to engage an accountant and Blue Force Property Ltd will be happy to recommend discounted services negotiated with qualified 3rd parties.
All mortgage interest, utilities and council taxes paid are allowable expenses for tax purposes.
What happens if the property is vacant?
Generally the landlord assumes responsibility for payment of mortgages, utilities and local council taxes subject to any exemptions. Blue Force Property Ltd normally hold reserve funds on your behalf to pay these.
